شروط الخدمة واتفاقية الاستخدام

1. تعريفات

• "النظام": نظام عقاري برو لإدارة العقارات المتاح عبر aqaripro.net
• "المشترك": الشركة أو المؤسسة أو الفرد الذي يسجل حساباً في النظام
• "المستخدم": أي شخص مصرح له بالوصول إلى النظام ضمن حساب المشترك
• "بيانات المشترك": جميع البيانات التي يدخلها أو يحملها المشترك ومستخدموه
• "نحن" / "الشركة": Altazi Labs، مقدم نظام عقاري برو

2. وصف الخدمة

عقاري برو هو نظام سحابي لإدارة العقارات يشمل: إدارة العقارات والوحدات، التأجير، تحصيل الإيجارات، الصيانة، الشكاوى، التقارير المالية، والتفتيش. النظام متاح كخدمة اشتراك (SaaS).

3. التسجيل والحساب

• يجب أن تكون المعلومات المقدمة عند التسجيل صحيحة ودقيقة
• أنت مسؤول عن الحفاظ على سرية بيانات الدخول
• أنت مسؤول عن جميع الأنشطة التي تتم تحت حسابك
• يجب إبلاغنا فوراً عن أي استخدام غير مصرح به

4. الاشتراك والدفع

• الأسعار محددة في صفحة التسعير ويمكن تغييرها بإشعار مسبق 30 يوماً
• الاشتراكات السنوية تُجدد تلقائياً ما لم يتم الإلغاء
• يمكن الإلغاء في أي وقت — يستمر الوصول حتى نهاية الفترة المدفوعة
• لا يتم استرداد المبالغ المدفوعة للاشتراكات السنوية
• في حالة عدم الدفع، قد يتم تعليق الوصول بعد فترة سماح

6. الاستخدام المقبول

توافق على عدم:

• استخدام النظام لأي غرض غير قانوني
• محاولة الوصول غير المصرح به إلى بيانات مشتركين آخرين
• إعادة بيع أو ترخيص النظام لأطراف ثالثة
• نسخ أو تعديل أو هندسة عكسية للنظام
• تحميل محتوى ضار أو فيروسات
• استخدام النظام بطريقة تؤثر سلباً على أداء الخدمة للمشتركين الآخرين

7. مستوى الخدمة

• نسعى لتوفير النظام بنسبة تشغيل 99.9%
• قد تحدث فترات صيانة مجدولة بإشعار مسبق
• لا نضمن خلو النظام من الأخطاء بالكامل
• نوفر الدعم الفني عبر البريد الإلكتروني ونظام البلاغات داخل التطبيق

8. حماية البيانات والخصوصية

نلتزم بحماية بياناتك وفقاً لنظام حماية البيانات الشخصية (PDPL). لمزيد من التفاصيل، يرجى مراجعة سياسة الخصوصية.

• بيانات كل مشترك معزولة تماماً عن المشتركين الآخرين
• لا نصل إلى بيانات المشتركين إلا للدعم الفني بإذن صريح
• نطبق إجراءات أمنية شاملة لحماية البيانات

9. الملكية الفكرية

• نظام عقاري برو وجميع محتوياته (التصميم، الكود، الشعار) ملك لشركة Altazi Labs
• يُمنح المشترك ترخيصاً غير حصري وغير قابل للتحويل لاستخدام النظام خلال فترة الاشتراك
• لا يُسمح بإعادة إنتاج أو توزيع أو تعديل أي جزء من النظام

10. حدود المسؤولية

• النظام يُقدم "كما هو" بدون ضمانات صريحة أو ضمنية
• لا نتحمل المسؤولية عن أي خسائر غير مباشرة أو تبعية
• مسؤوليتنا الإجمالية لا تتجاوز قيمة الاشتراك المدفوع في الـ 12 شهراً الأخيرة
• أنت مسؤول عن دقة البيانات التي تدخلها في النظام
• أنت مسؤول عن الامتثال للأنظمة المحلية في استخدام النظام (مثل ضريبة القيمة المضافة)

11. التعليق والإنهاء

• يمكننا تعليق حسابك في حالة انتهاك هذه الشروط
• يمكننا إنهاء الخدمة بإشعار مسبق 90 يوماً
• يمكنك إلغاء اشتراكك في أي وقت من إعدادات الحساب
• عند الإنهاء: يمكنك تصدير بياناتك خلال 90 يوماً، بعدها تُحذف نهائياً

12. التعديلات

نحتفظ بحق تعديل هذه الشروط. سنبلغك بأي تغييرات جوهرية قبل 30 يوماً من دخولها حيز التنفيذ. استمرارك في استخدام النظام بعد التعديل يعني موافقتك على الشروط المحدثة.

13. القانون الواجب التطبيق وحل النزاعات

تخضع هذه الشروط لأنظمة المملكة العربية السعودية. في حالة نشوء نزاع، يُحل أولاً بالتفاوض الودي خلال 30 يوماً. إذا لم يُحل، يُحال إلى المحاكم المختصة في المملكة العربية السعودية.

• "Subscriber": The company, organization, or individual that registers an account
• "User": Any person authorized to access the system under a subscriber's account
• "Subscriber Data": All data entered or uploaded by the subscriber and their users
• "We" / "Company": Altazi Labs, provider of AqariPro

2. Service Description

AqariPro is a cloud-based property management system including: property and unit management, leasing, rent collection, maintenance, complaints, financial reports, and inspections. The system is provided as a subscription service (SaaS).

3. Registration and Account

• Registration information must be accurate and truthful
• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use

4. Subscription and Payment

• Prices are as listed on the pricing page and may change with 30 days' notice
• Annual subscriptions auto-renew unless cancelled
• You may cancel at any time — access continues until end of paid period
• No refunds for annual subscriptions
• Non-payment may result in account suspension after a grace period

You agree not to:

• Use the system for any unlawful purpose
• Attempt unauthorized access to other subscribers' data
• Resell or sublicense the system to third parties
• Copy, modify, or reverse-engineer the system
• Upload harmful content or viruses
• Use the system in a way that negatively impacts service performance for others

7. Service Level

• We aim for 99.9% uptime
• Scheduled maintenance may occur with advance notice
• We do not guarantee the system will be completely error-free
• Technical support is available via email and in-app reporting

8. Data Protection and Privacy

We protect your data in accordance with the Personal Data Protection Law (PDPL). See our Privacy Policy for details.

• Each subscriber's data is completely isolated from other subscribers
• We do not access subscriber data except for technical support with explicit permission
• We implement comprehensive security measures

9. Intellectual Property

• AqariPro and all its contents (design, code, logo) are owned by Altazi Labs
• Subscribers receive a non-exclusive, non-transferable license to use the system during their subscription
• Reproduction, distribution, or modification of any part of the system is not permitted

10. Limitation of Liability

• The system is provided "as is" without express or implied warranties
• We are not liable for indirect or consequential losses
• Our total liability shall not exceed the subscription fees paid in the preceding 12 months
• You are responsible for the accuracy of data you enter
• You are responsible for compliance with local regulations (such as VAT)

11. Suspension and Termination

• We may suspend your account for violation of these terms
• We may terminate the service with 90 days' notice
• You may cancel your subscription at any time from account settings
• Upon termination: you may export your data within 90 days, after which it will be permanently deleted

12. Changes

We reserve the right to modify these terms. We will notify you of material changes at least 30 days before they take effect. Continued use after changes constitutes acceptance.

13. Governing Law and Disputes

These terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes shall first be resolved through good-faith negotiation for 30 days. If unresolved, they shall be referred to the competent courts in Saudi Arabia.
